ในแต่ละยุคสมัยที่เวลาได้ทำให้เกิดการปรับปรุงเปลี่ยนแปลงสิ่งต่างๆ รอบข้าง และนำพาสิ่งเหล่านั้นให้ผ่านไป ในแต่ละช่วงชีวิตหมุนเวียนไปไม่จบสิ้นหลายๆ อย่างก้าวหน้าไปสู่การพัฒนา และขยับขยายขึ้น ดังนวัตกรรมที่ล้ำหน้า และเทคโนโลยีแทบที่ว่าต้องวิ่งตามให้ทันทุกวินาทีที่หายใจ กระนั้นผู้เขียนกลับรู้สึกแปลกใจกับเหตุการณ์อะไรหลายๆ อย่างที่หวังให้เติบโต แต่ตอนนี้สิ่งที่เห็น และเป็นอยู่กลับเดินถอยหลังกลับคืนสู่ช่องทางที่ตีบตัน
ย้อนกลับไปรำลึกถึงอดีตจวบจนถึงปัจจุบันในช่วงปีที่เพิ่งผ่านมาไม่นานเท่าไร มีเหตุการณ์หลายอย่างเกิดขึ้นอย่างมากมาย ทั้งทางด้านสังคม ในทางวัฒนธรรมประเพณีที่เกิดเป็น “เกาหลีฟีเวอร์” ซึ่งไม่ว่าจะเดินไปทางไหน ก็จะเห็นเยาวชนไทยตามกระแสเกาหลี เกิดความนิยมเกาหลี แต่งตัวสไตล์เกาหลี เรียนภาษาเกาหลี ทานอาหารเกาหลี ซึ่งเป็นผลมาจากการรับเอาค่านิยมข้ามทวีปจนอาจหลงลืมสิ่งที่น่าภาคภูมิใจของประเทศชาติไปบ้าง
หรือความเปลี่ยนแปลงในสังคม การรักษาสิทธิ์ของตนเองมากขึ้น ทำให้เกิดเสรีภาพใหม่ๆ จนบางครั้งเกิดเป็นเส้นแบ่งบางๆ ระหว่างสิทธิ และความเห็นแก่ตัว หรือแม้แต่ความเปลี่ยนแปลงทางการเมืองการปกครองที่ ณ ตอนนี้เองหลายฝ่ายก็ยังไม่สามารถหาจุดสรุปที่ลงตัวร่วมกันได้ ความเปลี่ยนแปลงทั้งหมดที่ได้กล่าวมานี้ ทำให้เราต้องปรับเปลี่ยนแบบแผนความเป็นอยู่ และปรับปรุงสิ่งรอบตัวหลายๆอย่างให้เอื้อกับวิถีชีวิตของคน
ซึ่งในขณะที่เรากำลังวุ่นอยู่กับการพยายามที่จะเปลี่ยนแปลงสิ่งรอบข้างให้รับกับทิศทางการดำเนินชีวิตอย่างที่เราเป็น แต่อีกหลายอย่างก็ไม่สามารถเปลี่ยนไปตามสิ่งที่คนต้องการได้ทั้งหมด โดยเฉพาะอย่างยิ่งสิ่งที่กำหนดไม่ได้ และเหนือความคาดหมายอย่าง “ธรรมชาติ”
กิจกรรมต่างๆ ของมนุษย์ที่เปลี่ยนแปลงไปตามความก้าวหน้าได้ก่อให้เกิดการใช้ทรัพยากรธรรมชาติจำนวนมหาศาล อย่างที่ไม่เคยปรากฏมาก่อน กิจกรรมใหม่ที่เกิดขึ้น และเปลี่ยนแปลงจากวิถีชีวิตแบบเดิม เกิดแนวคิด และกิจกรรมใหม่ในทุกด้านได้ส่งผลกระทบต่อธรรมชาติทั้งทางตรง และทางอ้อมอย่างไม่อาจหลีกเลี่ยง
การเปลี่ยนแปลงทางสังคมและวัฒนธรรมรวมไปถึงการ ใช้ชีวิตที่ไม่สมดุลกับระบบความสมบูรณ์ของทรัพยากรเชื่อมโยงไปกับการพัฒนา สังคม เศรษฐกิจ การเมือง ทำให้เกิดการขยายตัวที่ไม่รู้จักจบของเทคโนโลยีซึ่งเป็นผลให้เกิดการนำทรัพยากรธรรมชาติที่มีอยู่อย่างจำกัดมาใช้อย่างผิดๆ ผลที่ตามมาก็คือ การทำให้ชีวิตของมนุษย์ทั้งหมดต้องตกอยู่กับความหายนะที่กำลังเกิดขึ้นกับสิ่งแวดล้อมและระบบนิเวศน์
เพียงช่วงเวลาสั้นๆในรอบเดือนที่ผ่านมา กลับปรากฏเหตุการณ์รุนแรงอันเป็นสัญญาณที่ธรรมชาติส่งผ่านมาเตือนมนุษย์ ทั้งแผ่นดินไหว ภูเขาไฟในไอซ์แลนด์ปะทุ ฝูงแมลงเข้าทำลายพืชไร่ ภัยแล้งประเทศไทยไปจนถึงวิกฤติพายุฤดูร้อน และอุณหภูมิที่สูงขึ้นทุกวันๆ โดยเหตุการณ์ที่เกิดขึ้นทั้งหมดนี้มีสถิติสูงที่สุดที่ได้เคยมีมา
แม้ว่าความเจริญ และเทคโนโลยีจะก้าวหน้ามากแค่ไหน แต่ตราบใดที่มนุษย์ยังคงเร่งปรับปรุงปัจจัยภายนอกเพียงอย่างเดียว โดยลืมที่จะปรับเปลี่ยนสำนึก และรับผิดชอบ ตราบนั้นธรรมชาติอาจส่งสัญญาณอันตรายเพิ่มขึ้นสู่ระดับที่คุกคาม ให้มนุษย์ต้องเผชิญกับวิกฤตการณ์ธรรมชาติ ที่เชื่อมโยงไปสู่วิกฤตการณ์ในสังคมมนุษย์ทั้งการเมือง เศรษฐกิจ สังคม วัฒนธรรม
ดังนั้น ทุกสิ่งทุกอย่างของการเปลี่ยนแปลงที่เกิดขึ้นควรเป็นไปอย่างสมดุล และสัมพันธ์เพื่อให้ทุกสิ่งต่อจากนี้มีการเปลี่ยนแปลงไปในทิศทางที่ดีร่วมกันค่ะ

บทนำ: ความเป็นมาและความสำคัญของหลักกฎหมายทั่วไปทางปกครอง
ตามความในประมวลกฎหมายแพ่งและพาณิชย์ มาตรา 4 ที่บัญญัติว่า
“กฎหมายนั้น ต้องใช้ในบรรดากรณีซึ่งต้องด้วยบทบัญญัติใดๆ แห่งกฎหมายตามตัวอักษร หรือความมุ่งหมายของบทบัญญัตินั้นๆ เมื่อไม่มีบทกฎหมายที่ยกมาปรับคดีได้ ให้วินิจฉัยคดีนั้นตามจารีตประเพณีแห่งท้องถิ่น ถ้าไม่มีจารีตประเพณีเช่นว่านั้นให้วินิจฉัยคดีอาศัยเทียบกฎหมายที่ใกล้เคียงเป็นอย่างยิ่ง และถ้าบทกฎหมายเช่นนั้นก็ไม่มีด้วย ให้วินิจฉัยตามหลักกฎหมายทั่วไป”
มีประเด็นที่ต้องพิจารณาว่า นอกจากในทางกฎหมายเอกชน (กฎหมายแพ่ง)แล้ว ในขอบเขตของกฎหมายอื่นๆ โดยเฉพาะอย่างยิ่งกฎหมายปกครองนั้น มีหลักกฎหมายทั่วไปหรือไม่ และถ้าหากมีอยู่จะมีลักษณะเช่นใด สำหรับปัญหาเบื้องต้นนี้ได้เป็นที่ยุติแล้วในระบบกฎหมายปกครองของต่างประเทศโดยเฉพาะอย่างยิ่งในภาคพื้นยุโรป ซึ่ง “หลักกฎหมายทั่วไปทางปกครอง” (Les principes généraux du droit administratif) เป็นบ่อเกิดที่สำคัญของกฎหมายปกครองซึ่งมีลักษณะที่ไม่เป็นลายลักษณ์อักษร บรรดาองค์กรเจ้าหน้าฝ่ายปกครองและองค์กรตุลาการโดยเฉพาะอย่างยิ่งศาลปกครอง (1) อาจนำไปใช้เพื่อประโยชน์ในการพิจารณา วินิจฉัยชี้ขาดหรือดำเนินการเพื่อการจัดทำบริการสาธารณะ
อย่างไรก็ตามในวงการนิติศาสตร์ของประเทศไทยมักเพิกเฉยต่อการพัฒนา และค้นหาหลักกฎหมายทั่วไปทางปกครอง จนอาจจะเรียกได้ว่า ข้อความคิดว่าด้วยหลักกฎหมายทั่วไปทางปกครองในประเทศไทยในช่วงที่ผ่านมามิได้มีการพัฒนาขึ้นเลย
การศึกษาเกี่ยวกับหลักกฎหมายทั่วไปทางปกครอง จึงมีคุณประโยชน์ในแง่การทำความเข้าใจถึงประวัติศาสตร์ พัฒนาการ เนื้อหาสาระ ตลอดจนปัญหาของการนำหลักกฎหมายทั่วไปทางปกครองมาใช้ในประเทศไทย นอกจากนี้ การศึกษาถึงลักษณะของหลักกฎหมายทั่วไปทางปกครองอาจเป็นแนวทางในการค้นหาหลักกฎหมายทั่วไปทางปกครองที่อยู่เบื้องหลังบทบัญญัติของกฎหมายมหาชนในประเทศไทย แล้วทำให้หลักกฎหมายทั่วไปดังกล่าวปรากฏตัวขึ้นอย่างเป็นรูปธรรมในที่สุด
1. ความหมายและลักษณะของหลักกฎหมายทั่วไป
(ก) ความหมาย
เนื่องด้วยข้อความคิด (Concept) ว่าด้วยหลักกฎหมายทั่วไปมีปริมณฑลในการปรากฏตัวอย่างกว้างขวางทั้งกฎหมายภายใน และกฎหมายภายนอก (กฎหมายระหว่างประเทศ) สำหรับกฎหมายภายในนั้น โดยเฉพาะอย่างยิ่งในประเทศไทย หลักกฎหมายทั่วไปเป็นวัตถุแห่งการใช้ และการตีความอันเกี่ยวเนื่องกับนิติวิธีหลักของระบบกฎหมายพื้นฐานของประเทศ ทั้งในแดนกฎหมายเอกชน และในแดนของกฎหมายมหาชน ดังนั้น จึงมีผู้แสดงทรรศนะเกี่ยวกับลักษณะ และความหมายของหลักกฎหมายทั่วไปอย่างกว้างขวาง ในที่นี้จึงขอหยิบยกขึ้นพิจารณาบางส่วนเท่านั้น
หลวงประดิษฐมนูธรรม (ปรีดี พนมยงค์) และพระสารสารน์ประพันธ์ อธิบายว่า หลักกฎหมายทั่วไป หมายถึง หลักที่มนุษย์ซึ่งรวบรวมกันอยู่เป็นหมู่คณะหรือเป็นประเทศจะต้องประพฤติต่อกัน (2) นอกจากนี้ยังกล่าวอีกด้วยว่า ในบรรดาหลักกฎหมายทั่วไปที่แอบแฝงอยู่ในวิชชาต่างๆ ยังมีหลักกฎหมายทั่วไป ซึ่งจะต้องทราบเสียในเบื้องต้น เพราะจำเป็นที่สุดในการศึกษากฎหมายปกครอง คือ หลักว่าด้วยสิทธิของมนุษย์ชน (3)
ศาตราภิชาญ ดร.บวรศักดิ์ อุวรรณโณ ได้ให้ความหมายของหลักกฎหมายทั่วไปเอาไว้ว่า หลักกฎหมายทั่วไป ได้แก่ หลักกฎหมายซึ่งผู้พิพากษาผู้ทำหน้าที่ศาลในกฎหมายมหาชนค้นมาจากแหล่งต่างๆ เพื่อใช้บังคับในระบบกฎหมาย (4)
ศาสตราจารย์ (พิเศษ) ดร.วรพจน์ วิศรุตพิชญ์ เห็นว่า หลักกฎหมายทั่วไป ได้แก่ บรรดาหลักการที่เป็นรากฐานของระบบกฎหมายของประเทศทั้งระบบ บางหลักสืบสมุฏฐานว่ามาจากมูลบทเบื้องต้นของการปกครองระบอบเสรีประชาธิปไตย หรืออีกนัยหนึ่ง ระบอบรัฐธรรมนูญนิยม บางหลักสืบสมุฏฐานว่ามาจากตรรกะทางนิติศาสตร์ซึ่งหากไม่มีอยู่และจะเป็นช่องทางให้มีการใช้อำนาจตามอำเภอใจหรือเกิดสภาวะไร้ขื่อแปในบ้านเมือง (5)
นอกจากนี้ ผู้ช่วยศาสตราจารย์ ดร.จันทจิรา เอี่ยมมยุรา ได้ให้ความหมายของหลักกฎหมายทั่วไปทางปกครอง ว่า เป็นหลักกฎหมายที่ “แสดงให้ปรากฏ” โดยศาล โดยอาศัยการใช้สติปัญญาของตุลาการศาลปกครองในการวิเคราะห์ใคร่ครวญ คิดค้น บนพื้นฐานของการใช้เหตุผลในเชิงนิติศาสตร์จากข้อมูล (Matériels) ต่อไปนี้: ระบบกฎหมาย และแนวคิดปรัชญาการเมืองการปกครองของประเทศ บรรดาตัวบทกฎหมายทั้งหลายทั้งภายในและภายนอกรัฐ (รัฐธรรมนูญ, พ.ร.บ., คำประกาศ, ปฏิญญาสากลว่าด้วยสิทธิเสรีภาพขั้นพื้นฐานในกฎหมายระหว่างประเทศ ฯลฯ) (6)
สำหรับในทางตำราต่างประเทศนั้น Jean Rivéro ได้แสดงทรรศนะต่อหลักกฎหมายทั่วไปว่า ในรากฐานของทุกระบบกฎหมายจะมีข้อความคิดพื้นฐานของมนุษย์และโลกซึ่งก่อให้ เกิดหลักการพื้นฐานจำนวนหนึ่ง อันเป็นหลักในการดำเนินชีวิตของมนุษย์ที่อยู่รวมกันเป็นสังคม โดยหลักกฎหมายทั่วไปจะอิงอยู่กับหลักการพื้นฐานเหล่านี้ ทั้งนี้ การค้นพบหลักกฎหมายทั่วไปของศาลมีลักษณะสร้างสรรค์เป็นอย่างมาก โดยในการยืนยันความมีอยู่ของหลักหลักหนึ่ง ศาลจะกำหนดบทลงโทษกรณีมีการฝ่าฝืนหลัก และในขณะเดียวกันก็สอดแทรกหลักลงไปในกฎหมายที่มีอยู่ด้วย (7)
และ André de Laubadère เห็นว่า หลักกฎหมายทั่วไปเป็นหลักกฎหมายที่ศาลปกครองสร้างขึ้นโดยวางหลักกฎหมายทั่วไปดังกล่าวไว้ในคำพิพากษา นับเป็นบ่อเกิดของกฎหมายปกครองที่สำคัญประการหนึ่งโดยเฉพาะอย่างยิ่งในระบบที่ถือแนวคำพิพากษาของศาลปกครองเป็นการวางหลักกฎหมาย (Droit jurisprudentiel) เช่นประเทศฝรั่งเศส (8)
(ข) ลักษณะทั่วไป
จากนิยามของหลักกฎหมายทั่วไปในข้างต้น แสดงให้เห็นอัตลักษณะร่วมกันบางอย่างบางประการของหลักกฎหมายทั่วไป ซึ่งสามารถจำแนกได้ดังนี้
ประการแรก หลักกฎหมายทั่วไปเป็นหลักการที่อยู่เบื้องหลังระบบกฎหมายพื้นฐานของแต่ละประเทศ โดยเฉพาะอย่างยิ่งประเทศที่เป็นรัฐเสรีประชาธิปไตย มีความเคารพนับถือในศักดิ์ศรีความเป็นมนุษย์การพัฒนาหลักกฎหมายทั่วไปเพื่อคุ้มครองสิทธิเสรีภาพของประชาชนเป็นภารกิจหลักของระบบกฎหมายในรัฐนั้นๆ
ประการที่สอง หลักกฎหมายทั่วไปเป็นสิ่งที่มีอยู่แล้วโดยทั่วไป เพียงแต่ศาลจะเป็นผู้ทำให้ปรากฏตัวโดยการใช้ในการตัดสินบรรดาอรรถคดีเท่านั้น ซึ่งลักษณะดังกล่าวนี้เป็นอิทธิพลที่ได้รับมาจากสำนักความคิดกฎหมายธรรมชาติ (13) (Natural Law School) โดยรายละเอียดจะกล่าวถึงในต่อไป
อนึ่งสมควรกล่าวด้วยว่า ในประเทศฝรั่งเศส สภาแห่งรัฐ (Conseil d’État) มักจะใช้สำนวนโวหารที่แยบยลเมื่อจะกล่าวถึงหลักการหนึ่งหลักการใดที่ตนมุ่งหมายให้เป็นหลักกฎหมายทั่วไป เช่น สภาแห่งรัฐจะไม่กล่าวว่า “สภาแห่งรัฐสร้างหลักกฎหมายทั่วไป” แต่จะกล่าวว่า “สภาแห่งรัฐรับรองหลักกฎหมายนี้” แทน โดยนัยหมายความว่าหลักกฎหมาย (ทั่วไป) นั้นๆ มีอยู่แล้วในระบบกฎหมายหนึ่งๆ สภาแห่งรัฐเป็นเพียงผู้ไปค้นพบ และนำออกเผยแพร่ให้ปรากฏแก่สาธารณะชนเท่านั้น (9)
ประการที่สาม หลักกฎหมายทั่วไปเป็นสิ่งที่มีลักษณะเป็นเหตุผลเป็นผล ตามที่ได้กล่าวไปแล้วว่าหลักกฎหมายทั่วไปได้รับอิทธิพลจากสำนักกฎหมายธรรมชาติซึ่งมีแนวคิดเกี่ยวกับกฎหมายว่าเป็นเรื่องของเหตุผล (Reason) ที่แผ่ซ่านไปในทุกสรรสิ่ง สม่ำเสมอและเป็นนิรันดร์ (10) ดังนั้น หลักกฎหมายธรรมชาติจึงเป็นเรื่องของการใช้เหตุผลของนักกฎหมาย ซึ่งในที่นี้ ก็คือ ผู้พิพากษา ในการค้นหาและประกาศความดำรงอยู่ของหลักกฎหมายทั่วไปผ่านทางการใช้ในการคำตัดสิน ทำให้หลักกฎหมายทั่วไปเป็นเรื่องของเหตุผลของนักกฎหมาย
2. หลักกฎหมายทั่วไปทางปกครอง
(ก) ตำแหน่งแห่งที่ในกฎหมายลายลักษณ์อักษร
คำว่า “หลักกฎหมายทั่วไปทางปกครอง” ไม่ปรากฏเป็นที่ชัดแจ้งในบทบัญญัติแห่งกฎหมายที่เป็นลายลักษณ์อันมีผลใช้บังคับในประเทศ คงมีเพียงมาตรา 4 แห่งประมวลกฎหมายแพ่งและพาณิชย์เท่านั้นที่มีคำว่า “หลักกฎหมายทั่วไป” แต่ก็มีปัญหาอยู่ว่าคำว่าหลักกฎหมายทั่วไปนี้หมายเพียงแต่เฉพาะหลักกฎหมายทั่วไปในทางแพ่งใช่หรือไม่ ซึ่งผู้เขียนเห็นว่าหมายถึงหลักกฎหมายทั่วไปในทุกแขนงวิชาไม่ว่าจะเป็นกฎหมายเอกชน กฎหมายมหาชน กฎหมายอาญา หรือกฎหมายระหว่างประเทศ เหตุเพราะ
ประการแรก ในขณะที่ผู้ร่างทำการร่างมาตรา 4 แห่งประมวลกฎหมายแพ่งและพาณิชย์อยู่นั้น ในประเทศไทย ปรากฏเพียงประมวลกฎหมายลักษณะอาญา ร.ศ.127 เท่านั้น มีเป็นบทบัญญัติกฎหมายที่อยู่ในลักษณะประมวล (ซึ่งต่อมาก็มีการยกเลิกและแก้ไขใหม่) ผู้ร่างคงมีเจตจำนงจะกำหนดนิติวิธีหลักของกฎหมายในประเทศเอาไว้ ครั้นจะกำหนดไว้ในกฎหมายฉบับอื่นก็เห็นว่ายังไม่มี จึงเอามาใส่ไว้ในมาตรา 4 นี้ อย่างไรก็ตามในการนำมาใช้นั้นจะต้องทำเท่าที่ไม่ขัดต่อเจตนารมณ์ของกฎหมายนั้นๆ เช่น การใช้หลักกฎหมายทั่วไปทางปกครอง จะนำมาใช้ขยายขอบเขตอำนาจขององค์กรเจ้าหน้าที่ฝ่ายปกครองจนเป็นผลร้ายแก่ประชาชนไม่ได้
ประการที่สอง หลักกฎหมายทั่วไปในมาตรา 4 ประมวลกฎหมายแพ่ง และพาณิชย์เป็นเจตจำนงของผู้ร่างที่จะวางระบบวิธีการใช้และการตีความอันเป็นนิติวิธีหลักของประเทศ ดังนั้น จึงครอบคลุมถึงกฎหมายทุกประเภทด้วย
นอกจากนี้มีข้อพึงสังเกตว่าในระเบียบของที่ประชุมใหญ่ตุลาการในศาลปกครองสูงสุดฯ ข้อ 5 บัญญัติว่า
“วิธีพิจารณาคดีปกครองเป็นวิธีพิจารณาโดยใช้ระบบไต่สวนตามที่กำหนดไว้ในกฎหมายว่าด้วยการจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครองและระเบียบนี้ ในกรณีที่กฎหมายหรือระเบียบตามวรรคหนึ่งมิได้กำหนดเรื่องใดไว้โดยเฉพาะให้ดำเนินการตามหลักกฎหมายทั่วไปว่าด้วยวิธีพิจารณาคดีปกครอง”
(ข) แหล่งที่มาของหลักกฎหมายทั่วไปทางปกครอง
เราอาจจำแนกแหล่งที่มาของหลักกฎหมายทั่วไปทางปกครองได้ดังนี้ คือ
(1) บรรดารัฐธรรมนูญทั้งที่เป็นลายลักษณ์อักษรและไม่เป็นลายลักษณ์อักษร โดยเฉพาะอย่างยิ่งบทบัญญัติที่เกี่ยวกับสิทธิและเสรีภาพของประชาชน ถือได้ว่าเป็นแหล่งที่มาอันสำคัญของหลักกฎหมายทั่วไปประการหนึ่ง อย่างไรก็ตาม ในประเทศฝรั่งเศสนั้น ถือว่าปฏิญญาว่าด้วยสิทธิมนุษยชนและพลเมือง (la Déclaration des droits de l’homme et du citoyen)และ คำปรารภรัฐธรรมนูญฝรั่งเศส สาธารณรัฐที่ 4 เป็นแหล่งที่มาของหลักกฎหมายทั่วไปทางปกครองด้วย (11)
(2) หลักการพื้นฐานจากหลักกฎหมายทั่วไปทางแพ่งและวิธีพิจารณาความแพ่ง เช่น หลักในการฟังความทุกฝ่าย (Audi Alteram Patem) ซึ่งนำมาจากหลักกฎหมายวิธีพิจารณาความแพ่งในเรื่องการนำสืบพยาน อนึ่งสมควรกล่าวด้วยว่า มีผู้ไม่เห็นด้วยที่จะนำหลักการ และหลักกฎหมายทั่วไปทางแพ่งมาใช้ในทางกฎหมายมหาชน โดยเห็นว่าไม่เป็นผลดีต่อการบริหารราชการแผ่นดินและการคุ้มครองสิทธิเสรีภาพของประชาชน เพราะกฎหมายสองประเภทนี้มีหลักกฎหมายต่างกัน มีนิติวิธีต่างกัน เช่น ถ้านำทฤษฎีโมฆะกรรมของนิติกรรมทางแพ่งไปใช้กับนิติกรรมทางปกครองโดยสิ้นเชิงแล้ว ผลกระทบต่อการบริการราชการแผ่นดินก็จะเกิดขึ้น และความมั่นคงทางกฎหมายของนิติกรรมทางปกครองที่เจ้าหน้าที่กระทำก็จะไม่มีเลย (12) อย่างไรก็ตาม ผู้เขียนไม่เห็นพ้องด้วยกับแนวความคิดนี้เสียทีเดียว โดยเห็นว่าสามารถนำหลักกฎหมาย และหลักกฎหมายทั่วไปที่ปรากฏในกฎหมายเอกชนมาใช้กับกฎหมายมหาชนโดยเฉพาะอย่างยิ่งกฎหมายปกครองได้ แต่มีเงื่อนไขว่า จะต้องนำมาใช้ได้เท่าที่ไม่ขัดหรือแย้งกับหลักการพื้นฐาน และเจตนารมณ์ (Spirit) ของกฎหมายปกครอง
อนึ่งต้องไม่ลืมว่า หลักกฎหมายทั่วไปที่พัฒนามาแต่แรกเป็นเรื่องทางกฎหมายเอกชนเสียเกือบทั้งหมด กฎหมายมหาชนเองเพิ่งจะมีพัฒนาการปรากฏตัวเด่นชัดไม่นานมานี้ ดังนั้น เป็นเรื่องที่ไม่อาจจะหลีกเลี่ยงได้ที่จะนำหลักการหรือหลักกฎหมายจากกฎหมายเอกชนมาใช้ในกฎหมายมหาชนในฐานะที่มีมาก่อนกันนับร้อยปี อย่างไรก็ตาม สมควรกล่าวด้วยว่า ได้มีคำสั่งศาลปกครองสูงสุดที่ 433/2550 ได้วินิจฉัยว่า การรับสภาพความรับผิดโดยมีหลักฐานเป็นหนังสือตามมาตรา 193/28 วรรคสอง แห่งประมวลกฎหมายแพ่งและพาณิชย์เนื่องจากบทบัญญัติดังกล่าวเป็นหลักกฎหมายทั่วไป เมื่อพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 มิได้บัญญัติหลักเกณฑ์ดังกล่าวไว้ จึงสามารถนำบทบัญญัติมาตรา 193/28 วรรคสอง แห่งประมวลกฎหมายแพ่งและพาณิชย์มาใช้บังคับกับคดีปกครองได้
(3) คำพิพากษาของศาล อันเป็นผลพวงมาจากข้อความคิดพื้นฐานอันสืบสาวมาจากสำนักกฎหมายธรรมชาติ สิ่งเหล่านี้สะท้อนออกทางคำพิพากษาของศาลซึ่งมีลักษณะเป็นการค้นหาและแสดงออกทางคำพิพากษาที่เป็นลายลักษณ์อักษร โดยหลักกฎหมายทั่วไปในคำพิพากษานั้นๆ ได้รับการยอมรับนับถือจากศาลในคดีต่อๆ มาว่าเป็นสิ่งที่มีเหตุผลและเป็นหลักการที่สามารถนำมาใช้ได้
นอกจากนี้มีผู้สงสัยว่าบรรดาสุภาษิตโรมันเป็นแหล่งที่มาของหลักกฎหมายทั่วไปหรือไม่ ในเรื่องนี้ศาสตราจารย์ธานินทร์ กรัยวิเชียรและศาตราจารย์ (พิเศษ) วิชา มหาคุณ (14) เห็นว่า สุภาษิตกฎหมายโรมันเป็นที่มาของหลักกฎหมายทั่วไปด้วย แต่ศาสตราจารย์ไพจิตร ปุญญพันธ์ุ (15) เห็นว่า สุภาษิตก็คือสุภาษิต เป็นคำกล่าวธรรมดาที่ไม่อาจมีค่าบังคับเป็นหลักกฎหมายทั่วไปได้ ซึ่งผู้เขียนเห็นพ้องด้วยกับแนวความคิดหลังนี้
มีข้อพิจารณาบางประการว่า บรรดาหลักกฎหมายทั่วไปทางปกครองที่ได้รับการบัญญัติผ่านกระบวนการทางนิติบัญญัติออกมาเป็นกฎหมายลายลักษณ์อักษรจะยังคงมีสถานะเป็นกฎหมายทั่วไปอยู่หรือไม่ ในเรื่องนี้ศาตราจารย์ไพจิตร ปุญญพันธ์ (16) เห็นว่า การนำหลักกฎหมายทั่วไปมาบัญญัติเป็นกฎหมายลายลักษณ์อักษร ไม่หมายความว่าหลักกฎหมายทั่วไปจะสิ้นสภาพไป หลักกฎหมายทั่วไปยังคงอยู่ ด้วยความเคารพเป็นอย่างสูง ผู้เขียนไม่เห็นพ้องด้วยกับความคิดดังกล่าว โดยผู้เขียนเห็นว่าบรรดาหลักกฎหมายทั่วไปที่ถูกนำมาบัญญัติเป็นกฎหมายลายลักษณ์อักษรแล้วนั้นจะสิ้นสภาพการเป็นหลักกฎหมายทั่วไป เนื่องจากจะกลายเป็นบทบัญญัติลายลักษณ์อักษรที่องค์กรเจ้าหน้าที่ฝ่ายปกครองหรือศาลจะหยิบยกขึ้นมาใช้เป็นอันดับแรกในฐานะของบ่อเกิดกฎหมายปกครองลำดับแรกสุด ทั้งนี้ ตามหลักการกระทำทางปกครองต้องชอบด้วยกฎหมาย อันมีหลักการย่อยหลักการหนึ่งคือ หลักไม่มีกฎหมายไม่มีอำนาจซึ่งเรียกร้องให้ องค์กรเจ้าหน้าที่ฝ่ายปกครองจะกระทำการใดๆอันมีผลกระทบกระเทือนต่อสิทธิเสรีภาพของประชาชนได้ต่อเมื่อมีกฎหมายให้อำนาจไว้ และกฎหมายนั้นต้องแน่นอนชัดเจน ไม่มีผลย้อนหลังในทางเป็นโทษ บังคับใช้เป็นการทั่วไป (เสมอภาค) ได้สัดส่วน และไม่กระทบกระเทือนต่อสาระสำคัญแห่งสิทธิเสรีภาพ
ดังนั้น เราอาจกล่าวได้ว่า หลักกฎหมายทั่วไปทางปกครองไม่อาจเป็นที่มาของอำนาจของฝ่ายปกครองที่กระทำการอันมีผลกระทบต่อสิทธิเสรีภาพของประชาชนได้ ในขณะที่บทบัญญัติลายลักษณ์อักษรสามารถที่จะให้อำนาจองค์กรเจ้าหน้าที่ฝ่ายปกครองกระทำการดังกล่าวได้ เหตุผลดังกล่าวนี้จึงสอดรับกับการถือว่าหลักกฎหมายทั่วไปทางปกครองที่ถูกบัญญัติเป็นลายลักษณ์อักษรแล้วสิ้นสภาพการเป็นหลักกฎหมายทั่วไป และอยู่ในฐานะของกฎหมายที่ออกโดยฝ่ายนิติบัญญัติ
(ค) ลำดับศักดิ์ของหลักกฎหมายทั่วไปทางปกครอง
จากทฤษฎีลำดับชั้น และห่วงโซ่กฎหมายของ Hans Kelsen และ Adoft Merkle นำไปสู่การจัดลำดับชั้นของกฎหมายที่ใช้บังคับอยู่ในบ้านเมือง (Positive Law) โดยถือว่ารัฐธรรมนูญเป็นกฎหมายสูงสุดของประเทศ และบทบัญญัติที่ออกโดยสภานิติบัญญัติอยู่ในลำดับรองลงมา และตามมาด้วยกฎหมายอนุบัญญัติที่มาจากฝ่ายปกครอง ดังนั้น จึงเป็นปัญหาถกเถียงกันมาเป็นเวลานานว่าหลักกฎหมายทั่วไปทางปกครองควรอยู่ในลำดับชั้นใดใน
ในเรื่องนี้ Jean Rivéro (17) เห็นว่า หลักกฎหมายทั่วไปอยู่ในระดับต่ำกว่ากฎหมายที่ออกโดยสภานิติบัญญัติ เนื่องจากศาลเองก็ไม่อาจจะลงโทษผู้ที่ปฏิบัติฝ่าฝืนหลักกฎหมายทั่วไปได้ แต่อยู่เหนือการกระทำทุกอย่างของฝ่ายบริหาร ไม่ว่าจะเป็นพระราชกฤษฎีกาหรือพระราชกำหนดซึ่งมีผู้เห็นไปในทางเดียวกัน คือ ศาตราจารย์ชอง-ปีแอร์ เตรง (18) โดยเห็นว่า หลักกฎหมายทั่วไปทางปกครองอยู่ในลำดับชั้นสูงกว่ากฎหมายที่ออกโดยฝ่ายนิติบัญญัติแต่อยู่สูงกว่ากฎหมายของฝ่ายบริหาร
ดังนั้น เราจึงอาจกล่าวได้ว่า หลักกฎหมายทั่วไปทางปกครองมีลำดับชั้นสูงกว่ากฎหมายของฝ่ายปกครอง แต่อยู่ต่ำกว่าพระราชบัญญัติ อย่างไรก็ตาม สมควรกล่าวด้วยว่าหลักกฎหมายทั่วไปทางปกครองบางประการอันมีที่มาจากหลักการพื้นฐานของรัฐธรรมนูญย่อมมีค่าบังคับลำดับเดียวกับรัฐธรรมนูญ กล่าวอักนัยหนึ่งคือ มีค่าบังคับสูงกว่ากฎหมายของฝ่ายนิติบัญญัติ เช่น หลักความเสมอภาคและหลักความได้สัดส่วน
บทส่งท้าย
หลังจากที่ได้กล่าวถึงลักษณะโดยทั่วไปของหลักกฎหมายทั่วไปทางปกครองแล้ว ในโอกาสต่อไป ผู้เขียนจะได้นำเสนอประวัติและข้อความคิดทางประวัติศาสตร์เพื่อความเข้าใจมากยิ่งขึ้นของท่านผู้อ่านต่อไป อนึ่งสมควรกล่าวด้วยว่า การศึกษาเรื่องในทางวิชาการนั้น อาจจะเป็นการยากไปสักหน่อยสำหรับผู้ที่ไม่คุ้นชิน ทางผู้เขียนเองก็ได้ตระหนักถึงข้อนี้ดี จึงพยายามเป็นอย่างยิ่งในการปรับปรุงบทความนี้ให้อ่านง่ายที่สุดเท่าที่จะทำได้ แต่กระนั้นก็ตามศัพท์บางคำเป็นคำที่ใช้ในทางวิชาการจึงไม่อาจจะกล่าวให้ผิดแผกไปจากครรลองได้ จึงต้องขออภัยมา ณ ที่นี้ด้วย…

กลิ่นอายเย็นๆ ของประเพณีสงกรานต์ไทยยังไม่ทันจางหาย ไม่ทันไรเวลาก็เวียนมาเริ่มสัปดาห์แห่งการทำงานอีกรอบแล้ว หากประมวลเหตุการณ์ร้อนแข่งกับสภาพอากาศได้กล่าวว่ามีอะไรเกิดขึ้นมากเรื่องหลายราวเหลือเกินทั้งการเมือง การปกครอง การเปลี่ยนแปลง ยาวเรื่อยไปถึงเศรษฐกิจ และการลงทุน ก็เพิ่งหยุดยาวพร้อมเย็นกายกับสายน้ำสงกรานต์ไป แต่ก็ไม่รู้ว่าเมื่อไหร่จะถึงเวลาที่คนไทยจะได้เย็นใจยาวๆ สักที ตอนนี้หลบร้อนมาเรียนรู้กับ www.TopScholar.org ซึ่งสำหรับถนนวิชาการเส้นนี้แล้ว ก็คงมีหน้าที่ทอดยาวไปเรื่อย ตามเส้นทางแห่งการเรียนรู้ที่ไม่มีหยุดนิ่งต่อไป
จากกระแสเรียกร้องและข้อต่อรองที่รัฐบาลต้องเก็บไปคิดต่อ ทำให้ตอนนี้รัฐบาลไทยภายใต้การบริหารของอภิสิทธิ์ เวชชาชีวะ ต้องทำงานกับวิกฤตรอบด้าน วันนี้ผู้เขียนขอหลบเรื่องการเมืองอันน่าปวดหัว มามองเรื่องใกล้ๆ ตัวอย่างหนังสือกันดีกว่า ก็เพิ่งจบไปพร้อมกันทั้งประเพณีสงกรานต์ และงานสัปดาห์หนังสือนานาชาติ ที่นับถึงวันนี้ก็เวียนมาอีกรอบแล้วหลังจากที่คณะรัฐมนตรีออกมากำหนดให้ การอ่านหนังสือออกเป็นวาระแห่งชาติตั้งแต่วันที่ 5 สิงหาคม 2552 ลากยาวไปจนถึง ปี 2561 ที่ภาครัฐอุตส่าห์ลงแรงผลักดันนโยบายเพื่อที่จะสร้างวัฒนธรรมการอ่านและการเรียนรู้ตลอดชีพให้กับคนในสังคม
หลายกระแสที่วิพากษ์วิจารณ์รัฐบาลยุคใหม่ที่จัดตั้งคณะทำงานภายใต้กระทรวงศึกษาธิการขาดองค์ความรู้ทำให้ไม่สามารถผลักดันยุทธศาสตร์ที่วางแผนไว้ให้ออกมาเป็นรูปธรรมได้ ตอนนี้เมื่อมองเศรษฐกิจโลกโดยรวมแล้วมีความพร้อมจะพัฒนากำลังการผลิตสิ่งพิมพ์เพื่อสร้างสรรค์หนังสือดีๆสู่สังคม แต่… ปัจจัยลบที่อาจส่งผลกระทบต่อธุรกิจสิ่งพิมพ์ในปีนี้ ประการสำคัญที่ไม่ควรมองข้าม คือ เสถียรภาพทางการเมืองภายในประเทศ ที่พูดไปก็เหมือนกับใยแมงมุม พันกันยุ่งอีรุงตุงนังมาตั้งแต่ครั้งโบราณ
ปัญหาเชิงโครงสร้าง ช่องว่างระหว่างชนชั้น ที่ทำให้คนในสังคมเมืองมีการอ่านหนังสือ มากกว่าสังคมชนบท เหตุเพราะการศึกษาเป็นตัวแปรสำคัญ ในการปลูกจิตสำนึกผ่านพฤติกรรมคนไทย ที่ชอบจดจำจากการฟัง มากกว่าการอ่าน แต่ที่ผ่านมาภาครัฐกลับไม่ให้ความสนใจ แม้กระทั่งการจัดงบประมาณให้ลงไปถึงส่วนการศึกษาอย่างทั่วถึง ดังนั้นจึงต้องปรับเปลี่ยนวิธีคิด และเริ่มวิธีการจัดการใหม่ จากภาครัฐไปถึงทุกส่วนราชการทั้งส่วนกลาง ส่วนภูมิภาค องค์กรปกครองส่วนท้องถิ่นอย่างเท่าเทียม อีกทั้งต้องจัดสรรงบประมาณเพื่อส่งเสริมการอ่าน ทั้งในส่วนราชการเองและบริการประชาชนที่มารับบริการแต่ ณ ตอนนี้กับปัญหาที่รัฐบาลยังต้องเผชิญจะสามารถผลักดันการอ่านเพื่อสร้างสังคมแห่งการเรียนรู้ตลอดชีวิตได้มากแค่ไหน ก็คงต้องติดตามกันต่อไป
