1) บทนำ
ในขณะที่ผู้เขียนได้เขียนบทความนี้อยู่ ประเด็นหนึ่งที่อยู่ในความสนใจของสังคม คือ การตราพระราชกำหนดให้อำนาจกระทรวงการคลังกู้เงินเพื่อฟื้นฟูและเสริมสร้างความมั่นคงทางเศรษฐกิจ พ.ศ. 2552 ซึ่งมีผลใช้บังคับถัดจากวันที่ประกาศในราชกิจจานุเบกษา นั่นคือมีผลตั้งแต่วันที่ 13 พฤษภาคม พ.ศ. 2550 (1) ขั้นตอนต่อไปนับจากนี้ คณะรัฐมนตรีจะนำพระราชกำหนดฉบับดังกล่าวนี้เข้าสู่กระบวนพิจารณาของรัฐสภาเพื่อพิจารณาอนุมัติให้มีผลบังคับใช้มีค่าดังเช่นพระราชบัญญัติต่อไป
ผู้เขียนพิจารณาแล้ว เห็นควรเผยแพร่บทความเพื่อทำความเข้าใจในเบื้องต้นเกี่ยวกับการตราพระราชกำหนดและการควบคุมพระราชกำหนดมิให้ขัดรัฐธรรมนูญ ซึ่งน่าจะเป็นประโยชน์แก่บุคคลทั่วไปผู้สนใจ ดังมีรายละเอียดดังนี้
2) หลักการทั่วไป
จากแนวคิดเรื่องการแยกอำนาจ (La séparation des pouvoirs) นำไปสู่การแยกองค์กรผู้ใช้อำนาจอธิปไตยออกเป็น 3 องค์กร ได้แก่ องค์กรนิติบัญญัติ องค์กรบริการ และองค์กรตุลาการ ซึ่งแต่ละองค์กรต่างแยกการใช้อำนาจออกจากกันเพื่อมิให้เกิดการรวมอำนาจอันอาจจะส่งผลกระทบกระเทือนต่อสิทธิและเสรีภาพของประชาชน
องค์กรทั้งสามต่างมีภารกิจเป็นของตัวเอง โดยเฉพาะอย่างยิ่ง ที่จะกล่าวถึงในที่นี้คือ องค์กรนิติบัญญัติ ซึ่งก็คือ รัฐสภาในระบบกฎหมายไทย และองค์กรบริหารหรือที่เรียกว่ารัฐบาล ซึ่งตามหลักแล้ว ฝ่ายนิติบัญญัติจะมีอำนาจหน้าที่ในการริเริ่มกฎหมายได้ด้วยตนเอง การตรากฎหมายจึงเป็นภารกิจหลักของรัฐสภา เหตุที่เป็นเช่นนี้เพราะ ความเกี่ยวเนื่องอันชอบธรรมอย่างไม่ขาดสายระหว่างประชาชนผู้เป็นเจ้าของอำนาจอธิปไตย ที่ได้ให้ความไว้วางใจเลือกผู้แทนของตนเข้ามาทำหน้าที่ในรัฐสภาตามหลักประชาธิปไตย ซึ่งลักษณะดังกล่าวนี้เปรียบประหนึ่งการมอบอำนาจ อันเป็นอาณัติว่าประชาชนทุกคนต้องผูกพันตนในการบังคับใช้บรรดาบทกฎหมายที่ออกโดยฝ่ายนิติบัญญัตินี้ แม้ว่าบางครั้งกฎหมายนี้อาจกระทบกระเทือนต่อสิทธิเสรีภาพของตนบ้างก็ตาม (2) เราจึงอาจเรียกกฎหมายที่ออกโดยฝ่ายนิติบัญญัติว่าเป็นกฎหมายโดยแท้ เพราะออกจากองค์กรที่มีภารกิจโดยตรงในการตรากฎหมาย
อย่างไรก็ตาม แม้อำนาจในการริเริ่มและตรากฎหมายจะเป็นภารกิจของฝ่ายนิติบัญญัติ แต่หลักดังกล่าวอาจมีข้อยกเว้นอยู่บ้างหากมีเหตุที่จำเป็นจะต้องออกกฎหมายมาใช้บังคับ เพื่อให้ทันต่อเหตุการณ์ฉุกเฉิน ดังนั้น รัฐธรรมนูญจึงเปิดโอกาสให้ฝ่ายบริหารสามารถริเริ่มและตรากฎหมายขึ้นเองได้ อันได้แก่ พระราชกำหนด (Emergency decree) ดังนั้นเราจึงอาจเรียกพระราชกำหนดว่าเป็นกฎหมายของฝ่ายบริหารก็ได้
ประเด็นที่ต้องพิจารณา คือ ตามหลักการแยกอำนาจการอนุญาตให้ฝ่ายบริหารสามารถตรากฎหมายออกใช้บังคับได้เองนั้นน่าจะเป็นเรื่องที่ไม่ถูกต้อง เนื่องด้วยเป็นการก้าวก่ายภารกิจและขัดต่อหลักการแยกอำนาจที่ประสงค์จะป้องกันมิให้องค์กรใดองค์กรหนึ่งใช้อำนาจมากกว่าหนึ่งอำนาจถึงขนาดมีผู้กล่าวว่า หลักการแยกอำนาจอาจจะถูกบ่อนทำลายไป “ก็เฉพาะแต่ในกรณีที่อำนาจทั้งปวงในแขนงหนึ่งกับอำนาจทั้งปวงในแขนงหนึ่งตกอยู่ในกำมือของบุคคลหรือองค์กรเดียวกันเท่านั้น” (The separation of powers principle is subverted only where the whole power of one department is exercised by the same hands which posses the whole power of another department) (3)
สำหรับประเด็นดังกล่าวนี้ หากพิจารณาอย่างถ้วนถี่แล้วจะพบว่า ท้ายที่สุดหากฝ่ายบริหารประกาศใช้พระราชกำหนด ฝ่ายบริหารก็จะถูกบังคับโดยบทบัญญัติแห่งรัฐธรรมนูญให้นำพระราชกำหนดดังกล่าวเข้าสู่กระบวนการอนุมัติของรัฐสภา (ฝ่ายนิติบัญญัติ) อีกครั้งหนึ่ง ตามหลักประชาธิปไตยจึงถือว่าเป็นกฎหมายที่ผ่านความเห็นชอบของผู้แทนอันมีความชอบธรรมของอำนาจจากประชาชนแล้ว เช่นเดียวกันกับการตราพระราชบัญญัติตามปกติ จึงไม่เป็นการขัดต่อหลักการแยกอำนาจแต่อย่างใด
เราอาจแบ่งประเภทของพระราชกำหนดตามที่บัญญัติในรัฐธรรมนูญแห่งราชอาณาจักรไทยออกเป็นสองประเภท ได้แก่ พระราชกำหนดทั่วไป ตามมาตรา 184 และ พระราชกำหนดเกี่ยวด้วยภาษีอากรหรือเงินตรา ตามมาตรา 186 สำหรับในบทความนี้จะพิจารณาเฉพาะพระราชกำหนดทั่วไป
3) เงื่อนไขในการตราพระราชกำหนด
ตามความในรัฐธรรมนูญแห่งราชอาณาจักรไทย มาตรา 184 วรรคหนึ่ง “ในกรณีเพื่อประโยชน์ในอันจะรักษาความปลอดภัยของประเทศ ความปลอดภัยสาธารณะ ความมั่นคงในทางเศรษฐกิจของประเทศหรือป้องปัดภัยพิบัติสาธารณะ พระมหากษัตริย์จะทรงตราพระราชกำหนดให้ใช้บังคับดังเช่นพระราชบัญญัติ” และในวรรคสอง “การตราพระราชกำหนดตามวรรคหนึ่ง ให้กระทำได้เฉพาะเมื่อคณะรัฐมนตรีเห็นว่าเป็นกรณีฉุกเฉินที่มีความจำเป็นเร่งด่วนอันมิอาจจะหลีกเลี่ยงได้”
พิจารณาจากถ้อยคำในรัฐธรรมนูญฯ แล้ว เราอาจแบ่งเงื่อนไขในการตราพระราชกำหนดได้ 2 ประการ คือ
1. เงื่อนไขเฉพาะเรื่อง เงื่อนไขเฉพาะเรื่องเรียกร้องให้เนื้อหาในการตราพระราชกำหนดจะต้องเกี่ยวกับเรื่อง ดังนี้ (1) การรักษาความปลอดภัยของประเทศ (2) การรักษาความปลอดภัยสาธารณะ (3) ความมั่นคงในทางเศรษฐกิจของประเทศ หรือ (4) การป้องปัดภัยพิบัติสาธารณะ
2. เงื่อนไขด้านความจำเป็น การอนุญาตให้ฝ่ายบริหารสามารถออกกฎหมายได้ ทั้งๆ ที่มิใช่ภารกิจโดยตรงของตน อาจถือได้ว่าเป็นข้อยกเว้นทางด้านหน้าที่เป็นการชั่วคราว ซึ่งการจะกระทำเช่นนี้ได้จะต้องมีเหตุสำคัญๆ อันมิอาจจะรอกระบวนการนิติบัญญัติตามปกติได้ ดังนั้น เงื่อนไขด้านความจำเป็น จึงเป็นเงื่อนไขอันหนึ่ง ที่เงื่อนไขในการออกพระราชกำหนดเรียกร้องให้ต้องมีอยู่ในขณะที่ฝ่ายบริหารตระเตรียมจะออกพระราชกำหนด โดยรัฐธรรมนูญแห่งราชอาณาจักรไทย มาตรา 184 วรรคสองได้ใช้ถ้อยคำว่า “กรณีฉุกเฉินที่มีความจำเป็นเร่งด่วนอันมิอาจจะหลีกเลี่ยงได้”
อย่างไรก็ตาม ในกรณีที่ฝ่ายบริหารจะตราพระราชกำหนดมาใช้บังคับ จะต้องมีเงื่อนไขทั้งสองประการเกิดขึ้นในเวลาที่พร้อมกัน จะขาดอันใดอันหนึ่งเสียมิได้ อาทิเช่น หากเป็นพระราชกำหนดที่เกี่ยวกับความมั่นคงในทางเศรษฐกิจของประเทศ (เงื่อนไขเฉพาะเรื่อง) จะต้องปรากฎว่าในขณะที่จะมีการตราพระราชกำหนดดังกล่าวมีกรณีฉุกเฉินจำเป็นเร่งด่วนอันมิอาจจะหลีกเลี่ยงได้ (เงื่อนไขด้านความจำเป็น) กล่าวอีกนัยหนึ่ง หากมิได้มีการตราพระราชกำหนดดังกล่าวออกใช้บังคับจะก่อให้เกิดความเสียหายอย่างร้ายแรงต่อประเทศ ซึ่งการตรวจสอบว่ามีเหตุทั้งสองประการเกิดขึ้นพร้อมกันหรือไม่ ถือเป็นพันธกิจของศาลรัฐธรรมนูญ ซึ่งจะกล่าวในหัวข้อต่อๆ ไป
4) การพิจารณาพระราชกำหนดโดยรัฐสภา
ตามที่ได้กล่าวไว้แล้วในข้างต้น ภารกิจในการตรากฎหมายย่อมเป็นขององค์กรนิติบัญญัติตามหลักการแยกอำนาจ แต่หากมีกรณีจำเป็น รัฐธรรมนูญก็อาจให้ฝ่ายบริหารตราพระราชกำหนดออกใช้บังคับได้ ซึ่งเมื่อได้ตราบังคับใช้แล้ว ตามหลักประชาธิปไตย มีหลักย่อยหลักหนึ่งที่เรียกว่าหลักการปกครอง โดยผู้แทนได้เรียกร้องให้บรรดาบทบัญญัติที่ออกใช้บังคับกับประชาชนจะต้องผ่านการพิจารณาของผู้แทน ที่มีที่มาจากความเห็นชอบของประชาชน (การเลือกตั้ง) ดังนั้น คณะรัฐมนตรี (ฝ่ายบริหาร) จะต้องนำพระราชบัญญัติดังกล่าวเข้าสู่กระบวนการอนุมัติของรัฐสภาเพื่อทำให้พระราชกำหนดผ่านการพิจารณาจากผู้แทนของประชาชน เพื่อเป็นไปตามหลักนิติรัฐ (État de droit) และหลักประชาธิปไตยอันเป็นหลักการพื้นฐานของระบอบการปกครองแบบประชาธิปไตย
รายละเอียดในการนำพระราชกำหนดเข้าสู่การพิจารณาขององค์กรนิติบัญญัติ รวมทั้งผลของการพิจารณาไม่ว่าจะอนุมัติหรือไม่นั้น ได้กำหนดอยู่ในรัฐธรรมนูญมาตรา 184 วรรคสามเป็นต้นไป ความดังนี้ “ในการประชุมรัฐสภาคราวต่อไป ให้คณะรัฐมนตรีเสนอพระราชกำหนดนั้นต่อรัฐสภาเพื่อพิจารณาโดยไม่ชักช้า ถ้าอยู่นอกสมัยประชุมและการรอการเปิดสมัยประชุมสามัญจะเป็นการชักช้า คณะรัฐมนตรีต้องดำเนินการให้มีการเรียกประชุมรัฐสภาสมัยวิสามัญเพื่อพิจารณาอนุมัติหรือไม่อนุมัติพระราชกำหนดโดยเร็ว ถ้าสภาผู้แทนราษฎรไม่อนุมัติ หรือสภาผู้แทนราษฎรอนุมัติแต่วุฒิสภาไม่อนุมัติและสภาผู้แทนราษฎรยืนยันการอนุมัติด้วยคะแนนเสียงไม่มากกว่ากึ่งหนึ่งของจำนวนสมาชิกทั้งหมดเท่าที่มีอยู่ของสภาผู้แทนราษฎร ให้พระราชกำหนดนั้นตกไป แต่ทั้งนี้ไม่กระทบกระเทือนกิจการที่ได้เป็นไปในระหว่างที่ใช้พระราชกำหนดนั้น
หากพระราชกำหนดตามวรรคหนึ่งมีผลเป็นการแก้ไขเพิ่มเติมหรือ ยกเลิกบทบัญญัติแห่งกฎหมายใด และพระราชกำหนดนั้นต้องตกไปตามวรรคสาม ให้บทบัญญัติแห่งกฎหมายที่มีอยู่ก่อนการแก้ไขเพิ่มเติมหรือยกเลิก มีผลใช้บังคับต่อไปนับแต่วันที่การไม่อนุมัติพระราชกำหนดนั้นมีผล
ถ้าสภาผู้แทนราษฎรและวุฒิสภาอนุมัติพระราชกำหนดนั้น หรือถ้าวุฒิสภาไม่อนุมัติและสภาผู้แทนราษฎรยืนยันการอนุมัติด้วยคะแนนเสียงมากกว่ากึ่งหนึ่งของจำนวนสมาชิกทั้งหมดเท่าที่มีอยู่ของสภาผู้แทนราษฎร ให้พระราชกำหนดนั้นมีผลใช้บังคับเป็นพระราชบัญญัติต่อไป
การอนุมัติหรือไม่อนุมัติพระราชกำหนด ให้นายกรัฐมนตรีประกาศในราชกิจจานุเบกษา ในกรณีไม่อนุมัติ ให้มีผลตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษา การพิจารณาพระราชกำหนดของสภาผู้แทนราษฎรและของวุฒิสภาในกรณียืนยันการอนุมัติพระราชกำหนด จะต้องกระทำในโอกาสแรกที่มีการประชุมสภานั้นๆ”
ข้อสังเกตของผู้เขียนพบว่า โดยทั่วไปแล้วนั้น มักเข้าใจผิดถ้อยคำ ให้พระราชกำหนดนั้นมีผลใช้บังคับเป็นพระราชบัญญัติต่อไป โดยมักจะเข้าใจผิดแปลความว่า ให้พระราชกำหนดที่ผ่านการอนุมัติแล้ว เปลี่ยนชื่อเป็นพระราชบัญญัติ ซึ่งที่ถูกต้องนั้น ต้องหมายความว่า ให้พระราชกำหนดที่ผ่านการอนุมัติจากฝ่ายนิติบัญญัติมีศักดิ์และค่าในการบังคับใช้เท่ากับพระราชบัญญัติ แต่ยังคงชื่อเป็นพระราชกำหนดเช่นเดิม ตัวอย่างเช่น พระราชกำหนดการบริหารบ้านเมืองในสถานการณ์ฉุกเฉิน พ.ศ. 2548 ซึ่งได้รับการอนุมัติจากฝ่ายนิติบัญญัติมาตั้งแต่ พ.ศ. 2548 แล้ว โดยมิได้มีการเปลี่ยนชื่อเป็นพระราชบัญญัติแต่อย่างใด
5) การตรวจสอบความชอบด้วยรัฐธรรมนูญของพระราชกำหนดโดยศาลรัฐธรรมนูญ
หลักนิติรัฐ (État de droit) เรียกร้องให้มีการควบคุมตรวจสอบความชอบของการกระทำ ไม่ว่าจะเป็นฝ่ายบริหารหรือฝ่ายนิติบัญญัติโดยฝ่ายตุลาการ สำหรับประเทศไทยใช้ระบบศาลคู่ที่นอกจากจะมีศาลยุติธรรม ศาลปกครองแล้ว ยังมีศาลรัฐธรรมนูญ (5) ซึ่งทำหน้าที่ตรวจสอบการกระทำที่มีเขตอำนาจพิจารณาความชอบขององค์กรที่ใช้อำนาจโดยตรงจากรัฐธรรมนูญ
โดยที่มาตรา 185 รัฐธรรมนูญ เปิดโอกาสให้ ก่อนที่สภาผู้แทนราษฎรหรือวุฒิสภาจะได้อนุมัติ พระราชกำหนดใด สมาชิกสภาผู้แทนราษฎรหรือสมาชิกวุฒิสภาจำนวนไม่น้อยกว่า 1 ใน 5 ของจำนวนสมาชิกทั้งหมดเท่าที่มีอยู่ของแต่ละสภา มีสิทธิเข้าชื่อเสนอความเห็นต่อประธานแห่งสภาที่ตนเป็นสมาชิกว่าพระราชกำหนดนั้นไม่เป็นไปตามเงื่อนไขทั้งสองประการดังที่ได้กล่าวไว้แล้วในข้างต้น และให้ประธานแห่งสภานั้นส่งความเห็นไปยังศาลรัฐธรรมนูญภายใน 3 วันนับแต่วันที่ได้รับความเห็นเพื่อวินิจฉัย เมื่อศาลรัฐธรรมนูญวินิจฉัยแล้ว ให้ศาลรัฐธรรมนูญแจ้งคำวินิจฉัยนั้นไปยังประธานแห่งสภาที่ส่งความเห็นนั้นมา
เมื่อประธานสภาผู้แทนราษฎรหรือประธานวุฒิสภาได้รับความเห็นของสมาชิกสภาผู้แทนราษฎรหรือสมาชิกวุฒิสภาตามวรรคหนึ่งแล้ว ให้รอการพิจารณาพระราชกำหนดนั้นไว้ก่อนจนกว่าจะได้รับแจ้งคำวินิจฉัยของศาลรัฐธรรมนูญ
ในกรณีที่ศาลรัฐธรรมนูญวินิจฉัยว่าพระราชกำหนดใดไม่เป็นไปตามเงื่อนไขทั้งสองประการ ให้พระราชกำหนดนั้นไม่มีผลบังคับมาแต่ต้น โดยคำวินิจฉัยของศาลรัฐธรรมนูญต้องมีคะแนนเสียงไม่น้อยกว่า 2 ใน 3 ของจำนวนตุลาการศาลรัฐธรรมนูญทั้งหมด
แต่เดิม รัฐธรรมนูญ ฉบับ พ.ศ. 2540 ไม่เปิดโอกาสให้ศาลรัฐธรรมนูญวินิจฉัยเงื่อนไขที่ว่าเป็นกรณีฉุกเฉินที่มีความจำเป็นเร่งด่วนอันมิอาจจะหลีกเลี่ยงได้ คงวินิจฉัยได้เพียงแค่พระราชกำหนดนั้นๆ เป็นเรื่องเกี่ยวกับการรักษาความปลอดภัยของประเทศ, การรักษาความปลอดภัยสาธารณะ, ความมั่นคงในทางเศรษฐกิจของประเทศ หรือการป้องปัดภัยพิบัติสาธารณะ หรือไม่ การเพิ่มเขตอำนาจให้แก่ศาลรัฐธรรมนูญในรัฐธรรมนูญฉบับปัจจุบัน เป็นสิ่งที่ดี อันถือเป็นหลักประกันนิติฐานะของประชาชนอีกประการหนึ่ง
6) บทส่งท้าย
ขณะเขียนบทความอยู่นี้ (26 พฤษภาคม 2552) พระราชกำหนดให้อำนาจกระทรวงการคลังกู้เงินเพื่อฟื้นฟูและเสริมสร้างความมั่นคงทางเศรษฐกิจ พ.ศ. 2552 กำลังอยู่ในขั้นตอนการพิจารณาของศาลรัฐธรรมนูญ ไม่ว่าแนวทางคำวินิจฉัยของศาลรัฐธรรมนูญออกมาเป็นเช่นไร ผู้เขียนเห็นว่า ย่อมส่งผลกระทบโดยรวมต่อเศรษฐกิจของประเทศไม่มากก็น้อย
อย่างไรก็ตาม บทความนี้มิได้มีวัตถุประสงค์วิพากษ์วิจารณ์กรณีดังกล่าว แต่หากมุ่งที่จะเผยแพร่ความรู้เข้าความใจทั่วไปในเบื้องต้นเกี่ยวกับพระราชกำหนด และเสริมสร้างความเข้าใจอันดีในเรื่องภารกิจอีกรูปแบบหนึ่งขององค์กรฝ่ายบริหาร ที่นอกจะมีอำนาจหน้าที่ในการบริหารประเทศแล้ว ยังมีอำนาจในการริเริ่มกฎหมายที่เรียกว่าพระราชกำหนดได้ด้วยตัวเองอีกด้วย และหากมีโอกาสในคราวต่อไป ผู้เขียนจะวิเคราะห์คำวินิจฉัยของศาลรัฐธรรมนูญสำหรับกรณีพระราชกำหนดให้อำนาจกระทรวงการคลังกู้เงินเพื่อฟื้นฟูและเสริมสร้างความมั่นคงทางเศรษฐกิจ พ.ศ. 2552 เท่าที่โอกาสและเวลาจะอำนวย

สำหรับ Editor Talk สัปดาห์นี้ไม่ขอพูดพร่ำทำเพลง ขอหยิบยกประเด็นเรื่องเงินๆ ทองๆ ที่กำลังเป็นที่จับตามองของคนไทยทั่วประเทศ กับเรื่องการกู้เงินจำนวนหลายแสนล้านบาทของรัฐบาล ซึ่งผู้เขียนได้ยินครั้งแรกก็ถึงกลับอึ้งกิมกี่ไปเลย ว่าจำเป็นที่ต้องกู้เงินจำนวนมหาศาลขนาดนั้นเชียวหรือ? เพราะที่ผ่านมาเราคนไทยทุกคนได้หายใจคล่องคอไปไม่กี่ปีกับการปลดหนี้ IMF และแน่นอนค่ะว่า ผู้อ่านจำนวนไม่น้อยทีเดียวที่ต้องเกิดข้อสงสัยในประเด็นดังกล่าวเช่นกัน อย่างน้อยต้องมีคำถามเกิดขึ้นมาในใจบ้างล่ะว่า นำมาใช้ส่วนไหน อย่างไร แล้วจะช่วยกระตุ้นเศรษฐกิจไทยได้จริงอย่างที่ว่าไว้หรือไม่ ล่าสุดหนังสือพิมพ์คมชัดลึก ฉบับวันที่ 15 พฤษภาคม 2552 ได้เสนอข่าวดังกล่าว ผู้เขียนอ่านข่าวแล้วก็อดไม่ได้ที่จะนำมาฝากท่านผู้อ่านกัน เพราะนับว่าเป็นข่าวที่คนไทยทุกคนควรจะได้รับรู้เพื่อติดตามกันต่อไป สำหรับเรื่องราวดังกล่าวสามารถติดตามได้ในรายละเอียดค่ะ
นายคณวัฒน์ วศินสังวร รองหัวหน้าพรรคเพื่อไทย กล่าวว่า พรรคเพื่อไทยมีมติยื่นศาลรัฐธรรมนูญวินิจฉัยพระราชกำหนดให้อำนาจกระทรวงการคลังกู้เงินเพื่อฟื้นฟูและเสริมสร้างความมั่นคงทางเศรษฐกิจ พ.ศ.2552 ซึ่งเป็นการกู้เงิน 4 แสนล้าน ที่ขัดรัฐธรรมนูญ 2550 มาตรา 184 โดยได้เข้าชื่อ ส.ส.ของพรรคจำนวนหนึ่งในห้าตามรัฐธรรมนูญ 185 กำหนดไว้ โดยพระราชกำหนดกู้เงินดังกล่าวขัดรัฐธรรมนูญ ในลักษณะซ่อนเงื่อน หลีกเลี่ยงการตรวจสอบของรัฐสภาโดยฉกฉวยแอบซ่อนงบประมาณกระตุ้นเศรษฐกิจอื่นเข้าไปด้วย ขัดรัฐธรรมนูญ ไม่เป็นไปตามมาตรา 184 วรรคสอง ซึ่งกำหนดให้กู้เงินได้เท่าที่ฉุกเฉินที่มีความจำเป็นอันมิอาจหลีกเลี่ยงได้เท่านั้น การออกพระราชกำหนดกู้เงินเพื่อเสริมสภาพคล่องเงินคงคลังที่ร่อยหรอลงจำนวน 2 แสนล้านบาทเป็นเรื่องเข้าใจได้ว่าฉุกเฉินมีความจำเป็นเร่งด่วน แต่การออกพระราชกำหนดกู้เงินเกินกว่าจำนวนดังกล่าวอีก 2 แสนล้านบาทเพื่อเป็นกองทุนเงินนอกงบประมาณเพื่อการลงทุนนั้นขัดต่อรัฐธรรมนูญ
รองหัวหน้าพรรคเพื่อไทย กล่าวว่า การออกพระราชกำหนดกู้เงิน 4 แสนล้านบาทเป็นหลักฐานความล้มเหลว และผิดพลาดในการบริหารเศรษฐกิจของรัฐบาลนายอภิสิทธิ์ เวชชาชีวะ ที่ผิดพลาดไปจากเป้าหมายมากจนไม่สามารถปิดหีบงบประมาณปี 2552ได้ ก่อนหน้านี้รัฐบาลก็เคยคิดจะเอาเงินกองทุนนอกงบประมาณมาเสริมสภาพคล่องให้เงินคงคลัง แต่ถูกคัดค้าน มิหนำซ้ำรัฐบาลยังกู้เงินเกินมากกว่าที่จำเป็นอีก 2 แสนล้านมาเป็นเงินนอกงบประมาณ อ้างความจำเป็นจากภาวะเศรษฐกิจทรุดตัว แต่แฝงไว้ใช้ในภารกิจทางการเมืองของรัฐบาลและหลีกเลี่ยงการตรวจสอบจากรัฐสภา ทั้งๆที่งบประมาณรายจ่ายประจำปีและงบกลางปี 2552 ยังเบิกจ่ายได้ไม่เต็มที่
ในขณะที่เหลือเวลาอีกเพียง 4 เดือนเท่านั้น ในปีงบประมาณ 2552 อีกทั้งการจัดทำงบประมาณเพิ่มเติมปี 2552 จำนวน 1.1 แสนล้านบาท ซึ่งน้อยกว่า ยังต้องผ่านการพิจารณาสามวาระจากรัฐสภาใช้เวลาอภิปรายหลายวัน ดังนั้น การออกกฎหมายกู้เงินเพื่อการลงทุนในลักษณะกองทุนเงินนอกงบประมาณนี้ไม่ถูกต้อง จึงต้องการให้ศาลรัฐธรรมนูญวินิจฉัยไว้เป็นบรรทัดฐานซึ่งถ้าปล่อยไป ต่อไปรัฐบาลชุดใหม่จะหลีกเลี่ยงการจัดทำงบประมาณรายจ่ายตาม พ.ร.บ.ประมาณรายจ่ายปี 2502 เพราะต้องถูกอภิปรายตรวจสอบจากรัฐสภา
นายคณวัฒน์ กล่าวด้วยว่า ในเรื่องดังกล่าว ถ้ารัฐบาลมั่นใจว่าทำถูกต้อง ตนอยากให้ออกรายการโทรทัศน์ เพื่อชี้แจงเหตุผลกับประชาชนให้ชัดเจน ซึ่งไม่จำเป็นต้องให้นายกรัฐมนตรี หรือ รมว.คลัง มา เพียงขอให้ นายกอร์ปศักดิ์ สภาวสุ รองนายกรัฐมนตรี ฝ่ายเศรษฐกิจ มาร่วมชี้แจงก็พอ จะได้ให้คนไทยทั้งประเทศรับทราบอย่างโปร่งใส
เรื่องแบบนี้ผู้เขียนเห็นว่ามีประชาชนคนไทยไม่น้อยเลยที่มีความคิดเห็นที่เห็นด้วย และ คัดค้าน แต่ที่สุดแล้วคงดีไม่น้อยหากเราทุกคนร่วมกันแก้ไขหาทางออกและมีคำตอบที่โปร่งใส เพื่อการนำวิธีการแก้ปัญหานั้นๆ มาใช้เพื่อให้เกิดผลระยะยาว และเพื่อผลประโยชน์ที่คนไทยทุกคนจะได้รับอย่างแท้จริง มิใช่ผลประโยชน์ของคนไทยกลุ่มใดกลุ่มหนึ่งเท่านั้น

บทนำ
โดยที่ศาลปกครองระยองได้มีคำพิพากษากรณีประชาชนฟ้องคณะกรรมการสิ่งแวดล้อมแห่งชาติ ละเลยต่อหน้าที่และร้องขอให้ประกาศให้มาบตาพุดเป็นเขตควบคุมมลพิษ หากท่านที่ติดตามข่าวสารอยู่ก็พอที่จะผ่านหูผ่านตาไปบ้าง อย่างไรก็ตาม ในเรื่องนี้มีประเด็นทางวิชาการที่เป็นข้อสงสัยให้ต้องพิจารณาอยู่ประการ หนึ่งคือ คำพิพากษาของศาลปกครองระยอง (ชั้นต้น) ดังกล่าวนี้ ขัดต่อหลักนิติรัฐ (État de droit) ที่เรียกร้องให้ฝ่ายตุลาการต้องสำรวมตนไม่เข้าไปก้าวล่วงการปฏิบัติงานของฝ่ายบริหาร (ฝ่ายปกครอง) หรือไม่? และอย่างไร?
ข้อเท็จจริงของคดี
ผู้ร้องได้ฟ้องคณะกรรมการสิ่งแวดล้อมแห่งชาติต่อศาลปกครองระยอง (ศาลชั้นต้น) ในฐานละเลยต่อหน้าที่ที่ต้องปฏิบัติตามกฎหมาย และขอให้คณะกรรมการสิ่งแวดล้อมแห่งชาติประกาศให้มาบตาพุดเป็นเขตควบคุมมลพิษตามความในพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ตามความในมาตรา 59 แห่งพระราชบัญญัติส่งเสริมและรักษาคุณภาสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ซึ่งบัญญัติว่า “ในกรณีที่ปรากฏว่าท้องที่ใดมีปัญหามลพิษซึ่งมีแนวโน้มว่าจะร้ายแรงถึงขนาดเป็นอันตรายต่อสุขภาพอนามัยของประชาชน หรืออาจก่อให้เกิดผลกระทบเสียหายต่อคุณภาพสิ่งแวดล้อม ให้คณะกรรมการสิ่งแวดล้อมแห่งชาติมีอำนาจประกาศในราชกิจจานุเบกษากำหนดให้ท้องที่นั้นเป็นเขตควบคุมมลพิษเพื่อดำเนินการควบคุม ลด และขจัดมลพิษได้” ศาลปกครองระยองได้มีคำพิพากษาศาลปกครองที่ 192/2550 สั่งให้คณะกรรมการสิ่งแวดล้อมแห่งชาติ ประกาศให้มาบตาพุดเป็นเขตควบคุมมลพิษ ภายใน 60 วันนับแต่มีคำพิพากษา (3 มีนาคม 2552)
คำพิพากษาขัดกับหลักนิติรัฐหรือไม่?
หลักนิติรัฐ (État de droit) เรียกร้องให้มีการแบ่งแยกอำนาจระหว่างฝ่ายบริการ ฝ่ายตุลาการ และฝ่ายนิติบัญญัติ โดยอำนาจทั้ง 3 จะต้องมีลักษณะตรวจสอบ และถ่วงดุล (Check and Balance) ซึ่งกันและกันได้ โดยมองเตสกิเออร์ได้กล่าวไว้ในวรรณกรรมเรื่อง จิตวิญญาณแห่งกฎหมาย (I’Esprit des lois) อย่างน่าฟังว่า การปล่อยให้องค์กรใดองค์หนึ่ง ใช้อำนาจมากกว่าหนึ่งอำนาจ สิทธิและเสรีภาพของประชาชนย่อมถูกกระทบกระเทือนอย่างแน่แท้ แก่นทางความคิดที่สะท้อนผ่านวรรณกรรมดังกล่าว เป็นข้อยืนยันอย่างชัดเจนว่า มองเตสกิเออร์ใช้เกณฑ์องค์กรเป็นหลักในการแบ่งแยกอำนาจ (1)
หลักย่อยหลักหนึ่งในหลักนิติรัฐ คือ หลักการกระทำทางตุลาการต้องชอบด้วยกฎหมาย ซึ่งหลักการนี้เรียกร้องให้ฝ่ายตุลาการต้องสำรวมตนไม่ไปก้าวล่วงใช้อำนาจในทางบริหาร (ฝ่ายปกครอง) และนิติบัญญัติ อีกทั้งต้องไม่ริเริ่มการใช้อำนาจวินิจฉัยอรรถคดีโดยไม่มีผู้ร้องขอ นอกจากนี้ ฝ่ายตุลาการต้องเป็นอิสระ ปราศจากการก้าวก่ายหรือแทรกแซงจากฝ่ายบริหารและฝ่ายนิติบัญญัติ ดังนั้น เราควรระมัดระวังมิให้ฝ่ายตุลาการก้าวล่วงอำนาจฝ่ายบริหาร มิเช่นนั้นจะเป็นกรณีที่เรามีการปกครองโดยตุลาการ (Gorvernement des Judge)
พิจารณาจากกรณีมาบตาพุด ด้วยความเคารพต่อศาลปกครองระยอง ผู้เขียนไม่เห็นพ้องด้วยกับคำพิพากษานี้ เพราะ
ประการแรก ตามความในพระราชบัญญัติจัดตั้งศาลปกครองและวิธีพิจารณาคดีปกครอง พ.ศ. 2542 มาตรา 72 (2) ที่กำหนดขอบเขตการบังคับตามคำพิพากษานั้น ศาลปกครองไม่สามารถออกคำพิพากษาให้ฝ่ายปกครองกระทำการใดๆ ที่เป็นข่ายของดุลพินิจได้ อีกทั้งยังไม่สามารถพิพากษาเป็นการสั่งการฝ่ายปกครองได้ ดังนั้น กรณีนี้ ศาลปกครองระยองจึงไม่สามารถมีคำพิพากษากำหนดให้คณะกรรมการสิ่งแวดล้อมแห่งชาติมีประกาศให้มาบตาพุดเป็นเขตควบคุมมลพิษ เพราะเป็นดุลพินิจที่คณะกรรมการสิ่งแวดล้อมแห่งชาติจะเลือกใช้มาตรการที่เหมาะสมในการกำกับดูแลบริเวณที่เกิดมลพิษ
ประการที่สอง เนื่องด้วยประเด็นเกี่ยวกับสิ่งแวดล้อมเป็นกรณีที่ต้องใช้ความรู้ความเชี่ยวชาญเฉพาะด้านในการพิจารณาสภาพของปัญหาสิ่งแวดล้อม และหลักทางวิชาการที่จะบำบัด บรรเทา หรือขจัดปัญหาดังกล่าวได้ ด้วยความเคารพ ผู้เขียนเห็นว่า ศาลปกครองมิใช่องค์ผู้เชี่ยวชาญทางด้านนี้ แม้จะมีการแบ่งหน่วยงานภายในศาลปกครองเป็นแผนกคดีสิ่งแวดล้อมก็ตาม ดังนั้น การที่ศาลปกครองก้าวล่วงเข้ามาพิจารณาถึงข้อเท็จจริง ที่ต้องใช้ความรู้ทางวิชาการสิ่งแวดล้อม จึงเป็นเรื่องที่ไม่สมควรกระทำ อีกทั้งนานาประเทศที่มีศาลปกครองก็เป็นที่ทราบกันดีว่า ศาลปกครองพยายามเป็นอย่างยิ่งที่จะหลีกเลี่ยง ไม่ตรวจสอบดุลพินิจของฝ่ายปกครองในเรื่องที่ต้องใช้ความชำนาญเฉพาะด้าน เว้นเสียแต่ว่า การใช้ดุลพินิจนั้นจะถึงขนาดเห็นได้ประจักษ์โดยสำนึกของวิญญูชนว่าผิดพลาด อย่างร้ายแรง
ประการที่สาม จากการศึกษาคำพิพากษาของศาลปกครองสูงสุดที่ผ่านมา มีกรณีที่คล้ายกัน พอเป็นบรรทัดฐานได้คือ คำพิพากษาศาลปกครองที่ อ.541/2551 ข้อเท็จจริงปรากฏว่า ในคดีนี้บริเวณข้างบ้านพักของผู้ฟ้องคดีเป็นโรงฆ่าสัตว์ (สุกร) ของผู้ถูกฟ้อง ซึ่งมูลสัตว์, เสียงร้องของสัตว์ และกลิ่นต่างๆรบกวนทำให้ผู้ฟ้องคดีเดือดร้อนรำคาญ ศาลปกครองพิจารณาตามความในพระราชบัญญัติการสาธารณสุข พ.ศ. 2535 มาตรา 25 ประกอบมาตรา 36 สรุปความว่า หากเกิดเหตุเดือดร้อนรำคาญขึ้น เจ้าพนักงานท้องถิ่นมีอำนาจที่จะออกคำสั่งเป็นหนังสือให้บุคคลที่เป็นต้นเหตุหรือเกี่ยวข้องระงับหรือป้องกันเหตุนั้นได้ ดังนั้น ศาลปกครองสูงสุดจึงมีคำพิพากษาให้เจ้าพนักงานท้องถิ่น (นายกเทศมนตรี) ออกคำสั่งหรือกำหนดมาตรการใดๆ ให้ระงับเหตุดังกล่าว
คำพิพากษานี้เป็นตัวอย่างที่ดีที่ศาลปกครองเคารพดุลพินิจของฝ่ายปกครอง โดยศาลได้พิพากษาเพียงว่าฝ่ายปกครองต้องทำตามหน้าที่ที่ตนละเลย แต่ให้อิสระในการเลือกใช้มาตรการตามที่ตนเห็นสมควรได้ ในทางตรงกันข้าม คดีมาบตาพุด ศาลปกครองระยองพิพากษาเป็นการสั่งให้ทำ ซึ่งไม่น่าจะถูกต้องเท่าไหร่นัก
บทสรุป
คดีสิ่งแวดล้อมถือเป็นคดีมหาชนที่ส่งผลกระทบต่อทุกภาคส่วนเป็นอันมาก ไม่ว่าเป็นประชาชนที่อาศัยอยู่บริเวณนั้นๆ หรือผู้ประกอบการ และภาคธุรกิจที่เกี่ยวข้อง การพิจารณาคดีประเภทนี้จึงได้รับความสนใจเป็นอย่างมากจากสังคม
อย่างไรก็ตาม บางครั้งที่ศาลพิจารณาวินิจฉัยให้ประชาชนชนะคดี อาจเป็นที่พอใจแก่สังคมและรู้สึกว่าเป็นธรรมอย่างที่สุด แต่บางครั้งกลับหลงลืมไปว่า ความถูกใจนั้น อาจไม่ใช่ความถูกต้องก็เป็นได้
ในฐานะที่ ฝ่ายตุลาการเหมือนเขตเงาสลัวแห่งการตรวจสอบ (3) เพราะหลักความเป็นอิสระของฝ่ายปกครองอันเป็นหลักการย่อยของหลักนิติรัฐได้ประกันการถูกแทรกแซงจากอำนาจอื่นๆ แต่เพื่อประโยชน์แก่ประชาชนและหลักการทางกฎหมายโดยแท้ เรามิควรดูดายให้ความถูกต้องและหลักนิติรัฐถูกบิดเบือนไป เพราะอคติแห่งความพอใจ หากเป็นเช่นนั้นฤา เราจะมีฝ่ายปกครองเป็นตุลาการและเราอาจถูกปกครองโดยตุลาการ (Gorvernement des Judge) ก็ได้

(1) สั่งให้เพิกถอนกฎหรือคำสั่งหรือสั่งห้ามการกระทำทั้งหมดหรือบางส่วนในกรณีที่มีการฟ้องว่าหน่วยงานทางปกครองหรือเจ้าหน้าที่ของรัฐกระทำการโดยไม่ชอบด้วยกฎหมายตามมาตรา 9 วรรคหนึ่ง (1)
(2) สั่งให้หัวหน้าหน่วยงานทางปกครองหรือเจ้าหน้าที่ของรัฐที่เกี่ยวข้องปฏิบัติตามหน้าที่ภายในเวลาที่ศาลปกครองกำหนด ในกรณีที่มีการฟ้องว่าหน่วยงานทางปกครองหรือเจ้าหน้าที่ของรัฐละเลยต่อหน้าที่หรือปฏิบัติหน้าที่ล่าช้าเกินสมควร
(3) สั่งให้ใช้เงินหรือให้ส่งมอบทรัพย์สินหรือให้กระทำการหรืองดเว้นกระทำการโดยจะกำหนดระยะเวลาและเงื่อนไขอื่นๆ ไว้ด้วยก็ได้ ในกรณีที่มีการฟ้องเกี่ยวกับการกระทำละเมิดหรือความรับผิดของหน่วยงานทางปกครองหรือเจ้าหน้าที่ของรัฐหรือการฟ้องเกี่ยวกับสัญญาทางปกครอง
(4) สั่งให้ถือปฏิบัติต่อสิทธิหรือหน้าที่ของบุคคลที่เกี่ยวข้อง ในกรณีที่มีการฟ้องให้ศาลมีคำพิพากษาแสดงความเป็นอยู่ของสิทธิหรือหน้าที่
(5) สั่งให้บุคคลกระทำหรือละเว้นกระทำอย่างหนึ่งอย่างใดเพื่อให้เป็นไปตามกฎหมาย
